The penalties for a DWI in Houston include, but are not limited to, substantial fines, possible jail time and the suspension of your driver’s license. 

  • 1st DWI-Class B Misdemeanor, Up to a $2,000 fine, punishable by 72 hours to 180 days in jail, loss of driver’s license for up to a year
  • 2nd DWI-Class A misdemeanor-up to $4,000 fine, 30 days to 1 year jail time, loss of license for up to two years
  • 3rd offense-  Third Degree Felony-$10,000 fine, 2 year minimum-10 years in prison, loss of license for up to two years
  • DWI with a child passenger- State Jail Felony-punishable by up to 2 years in jail, loss of driver’s license for 180 days and a fine up to $10,000
